1. ACCEPTANCE OF TERMS:

1.1 By accessing “myrecession.ie” (hereinafter “we”, “us”, “our”, “myrecession.ie”, http://www.myrecession.ie/forum, as the sense may require, and furthermore including, but not limited to, the owner(s) of this site, the controllers and administrators), you agree to be legally bound by all of the following terms of use:

1.2 If you do not agree to be legally bound by all of the following terms then please do not access and/or use “myrecession.ie”.

1.3 We may change these at any time and, while it is the policy of “myrecession.ie” to make the utmost effort to informing users of any such changes, “myrecession.ie” makes no representation and gives no warranty (whether contractual or otherwise) in this regard. 2.1 Our forums are powered by phpBB (hereinafter “they”, “them”, “their”, “phpBB software”, “www.phpbb.com”, “phpBB Group”, “phpBB Teams”) which is a bulletin board solution released under the “General Public License” (hereinafter “GPL”) and can be downloaded from www.phpbb.com. The phpBB software only facilitates internet based discussions, the phpBB Group are not responsible for what we allow and/or disallow as permissible content and/or conduct. 3. GENERAL CONTENT OF POSTING

3.1 You agree not to post any abusive, obscene, vulgar, slanderous, hateful, threatening, sexually-orientated or any other material that may violate any laws be it of your country, the country where “myrecession.ie” is hosted or International Law. Doing so may lead to you being immediately and permanently banned, with notification of your Internet Service Provider if deemed required by us. The IP address of all posts are recorded to aid in enforcing these conditions. You agree that “myrecession.ie” have the right to remove, edit, move or close any topic at any time should we see fit. As a user you agree to any information you have entered to being stored in a database. While this information will not be disclosed to any third party without your consent, neither “myrecession.ie” nor phpBB shall be held responsible for any hacking attempt that may lead to the data being compromised.

3.2 In the event of a violation of the laws of of the Republic of Ireland, the United Kingdom, the country where “myrecession.ie” is hosted, your country of residence/domicile, or any other country or jurisdiction being violated by your post, it is the policy of “myrecession.ie” to cooperate fully with such law enforcement investigations and prosecution which may follow.

4.1 Without prejudice to the generality of any other undertaking contained herein, you hereby undertake not to post any material, or post any link to any material, which is slanderous, libellous or otherwise, defamatory or otherwise unlawful (such term to include posts that are either civilly or criminally unlawful) under the laws of the Republic of Ireland, the United Kingdom, the country where “myrecession.ie” is hosted, your country of residence/domicile, or any other country or jurisdiction. You hereby agree to fully indemnify “myrecession.ie” in respect of any claims arising from any such slanderous, libellous, or otherwise , defamatory or otherwise unlawful material as may be caused or occasioned by any posting, link, material, picture (of whatever format or file type), video (of whatever format or file type), or sound recording (of whatever format or file type) by you on “myrecession.ie”.

4.2 “Myrecession.ie” is a moderated site and every effort is made to remove any material which may be slanderous, libellous or otherwise defamatory. If you observe any such material, please report it to an administrator at [abuse@myrecession.ie]. Notwithstanding, the attention of all users is drawn to the “Liability Waiver” below.

5. INTELLECTUAL PROPERTY:

5.1 Without prejudice to the generality of any other undertaking contained herein, you hereby undertake to refrain from posting any link, material, picture (of whatever format or file type), video (of whatever format or file type), or sound recording (of whatever format or file type) on “myrecession.ie” which violates the intellectual property rights of any third party whatsoever (regardless of the form or nature of such intellectual property rights, but including: trade mark(s), copyright, and patents as protected by the laws of the Republic of Ireland, the United Kingdom, the country where “myrecession.ie” is hosted, your country of residence/domicile, any international convention, or any other country or jurisdiction). You hereby agree to fully indemnify “myrecession.ie” in respect of any claims arising from the posting of any link, material, picture (of whatever format or file type), video (of whatever format or file type), or sound recording (of whatever format or file type) on “myrecession.ie” which violates the aforementioned intellectual property rights of any third party. 5.2 You hereby agree that the content of material posted on “myrecession.ie” including, but not limited to, any and all material appearing in “BOB’S BLOG, THE FORUM and the main website is the intellectual property of the owner(s) of “myrecession.ie”. You hereby undertake not to take any legal action (including, but not limited to, injunctive action) under the laws of the Republic of Ireland, the United Kingdom, the country where “myrecession.ie” is hosted, your country of residence/domicile, any international convention, or any other country or jurisdiction) to restrain the owner(s) of “myrecession.ie” from exercising their intellectual property rights in respect of any and all such material.

6. PRIVACY:

7.1 Without prejudice to any other term of use whatsoever, “myrecession.ie” (including, but not limited to, the owner(s), controllers and/or administrators of “myrecession.ie”) accept no liability whatsoever in respect of any civil claims pursuant to the laws of the Republic of Ireland, the United Kingdom, the country where “myrecession.ie” is hosted, your country of residence/domicile, or any other country or jurisdiction (whether such claims arise in contract, in tort, or otherwise) arising from the posting of any link, material, picture (of whatever format or file type), video (of whatever format or file type), or sound recording (of whatever format or file type) on “myrecession.ie” or arising from or being occasioned by your usage of “myrecession.ie”.

7.2 By agreeing the enter “myrecession.ie” you hereby agree to waive any right of action you might have against “myrecession.ie” (including, but not limited to, the owner(s), controllers and/or administrators of “myrecession.ie”) pursuant to the laws of the Republic of Ireland, the United Kingdom, the country where “myrecession.ie” is hosted, your country of residence/domicile, or any other country or jurisdiction arising from or being occasioned by your usage of “myrecession.ie”

7.3 For the avoidance of any doubt, no liability whatsoever is accepted by “myrecession.ie” (including, but not limited to, the owner(s), controllers and/or administrators of “myrecession.ie”) for any computer viruses, spyware, Trojan horses, malware and/or adware which your computer may be exposed to by accessing “myrecession.ie”. It is the policy of “myrecession.ie” not make every effort to avoid users being exposed to any such computer viruses, spyware, Trojan horses, malware and/or adware, but no warranties (contractual or otherwise) are given in this regard.

8. SEVERANCE:

8.1 If any individual term of use (or any part thereof) is deemed void or unenforceable pursuant to the laws of the Republic of Ireland, the United Kingdom, the country where “myrecession.ie” is hosted, your country of residence/domicile, or any other country or jurisdiction, you hereby agree that this shall not have any effect on the validity or enforceability of any and all such other terms as may appear in the terms of use herein, or the validity or enforceability of the balance of any particular term of use (in the event that only part thereof is deemed invalid and/or unenforceable).

9. RESERVE RIGHT TO BAN AND/OR PROHIBIT ACCESS:

9.1 Without prejudice to any other term of use, and for the avoidance of doubt, “myrecession.ie” expressly reserves the right to ban users from entering onto or posting material on the “myrecession.ie” forum. The right of “myrecession.ie” to ban users or to prohibit access in any way or for any period of time is absolute, and no warranties (in contract or otherwise) are given in this regard.

9.2 The owner(s), controller(s) and/or moderator(s) are not obliged whatsoever to tender any reasons as to why an individual user and/or account has been banned or otherwise had access prohibited.
